ImageWhat should petition letters include?

I would like to share my thoughts on what I believe petition letters (to persons, organisations, communities and governments) must include. Whilst keeping brief the part that covers the historical issues intended to educate the recipient, please base the greater part of the letters on the following factual and legal principles:
  • That the EEBC mandate to Delimit and Demarcate in accordance with Article 4.2 of the Algiers Agreement has been completed (Delimitation completed 13 April 2002 and Demarcation completed on 27 November 2006 and came into effect on 1 December 2007).
  • The EEBC Delimitation and Demarcation decisions, in accordance with Article 4.15 of the Algiers Agreement are "Final and Binding" with no rights of appeal.
  • Implementation of both these decisions is nothing more nothing less than respecting the boundary line as delimited and demarcated (by the EEBC decision) in accordance with Article 4.15 of the Algiers Agreement which states "Each party shall respect the border so determined, as well as the territorial integrity and sovereignty of the other party".
  • Ethiopia violated the Delimitation decision of 13 April 2002 almost immediately and continued to build new settlements and kept its troops north of the Delimitation boundary line. Since the boundary line of Demarcation took effect on 1 December 2007, Ethiopia shows no respect of this internationally recognised boundary and continues to build even more settlements and move in more troops on to the occupied territory. This is done at the expense of the original inhabitants who were displaced during war and are still in makeshift homes waiting to return to their original homes, which are occupied by Ethiopia.

The petition letter should call upon the recipient (persons, organisation, communities and governments):

  • To express support and recognition of the EEBC Demarcation decision of 27 November 2006 which came into effect on 1 December 2007 and
  • To call upon the Ethiopia Government:
    - to respect the border so determined (by EEBC), as well as the territorial integrity and sovereignty of the other party (Eritrea) in accordance with Article 4.15 of the Algiers Agreement.
    - to immediately withdraw its armed troops currently stationed north of the Demarcation line within sovereign Eritrean territory.
    - to dismantle settlements built since Delimitation decision of 13 April 2002 and to halt the creation of new settlements north of the Demarcation line.

In my humble opinion, it is not correct to assume or imply that the border commission is still in existence and will come back one day to place markers pillar on the border. I believe we should not give anyone the idea or the implication that just because the marker pillars are not placed on the ground the demarcation is not complete otherwise they will call for or support or encourage the appointment of a new "commission or mediator" to "demarcate the border". My fear is this could allow the evil genie locked in by the Algiers Agreement to pop out of the bottle and grant Meles his 5 year old wish.

On other matters such as the TSZ and the future of UNMEE, I believe it is not necessary to raise them within the petition letters. If, however, these issues come up during face to face meetings with the recipients, the response should be along the following lines:

  • Temporary Security Zone, which is entirely located within undisputed sovereign Eritrean territories formed by virtue of article 12 of the Secession of Hostility Agreement of 2000 to facilitate the delimitation and demarcation of the border seized to exist from 1 December 2007 when the Demarcation line took effect.
  • The mandate UNMEE which was formed by virtue Article 5 of the Secession of Hostility Agreement has expired also on the 1 December 2007 when the Demarcation line took effect.

The above comment is in no way meant to patronize you, other than to highlight any issue you may have overlooked.

Let us sing (and act) in unison from every mountains and valleys - the verse is "Demarcation is complete! No more TSZ! Final and binding Boundary Commission ruling must be respected!" and the chorus is "The regime in Ethiopia shall not be allowed to continue to occupy our sovereign territory and must accept and abide by the ruling and leave! One way or the other the regime shall be evicted!" Amen! Inshalah!

We shall continue to be united as ever and build economically and militarily strong Eritrea!
